The art world stands at a critical crossroads. While Artificial Intelligence (AI) offers new creative possibilities and economic opportunities, it also brings profound ethical, legal, and existential challenges. Prompted by the study on “AI and Art” commissioned by the Stiftung Kunstfonds and the Initiative Urheberrecht, this article explores the multifaceted contradictions and dilemmas surrounding the use of AI in the art market and the opposition of many artists.

The Precarious Situation of Artists

Artists worldwide struggle with insecure incomes and financial instability. Despite a global art market valued at around $67.8 billion in 2023, most artists remain financially disadvantaged. A comprehensive survey by Goldmedia GmbH shows that many artists fear losing their income opportunities due to the use of generative AI.

The Role of AI in the Art Market

AI has the potential to revolutionize creative processes. From image editing to the complete generation of artworks, the technology offers diverse applications. Examples like Beeple’s “Everydays,” which sold for $69 million in 2021, highlight the economic potential.

However, while a few artists benefit from new technologies, many others see their livelihoods threatened. AI can quickly and cheaply create artworks, leading to market saturation with inexpensive alternatives and reducing demand for human-created art.

Copyright and Intellectual Property

A central issue is the question of copyright. Many AI companies use copyrighted works without the artists’ consent and compensation. A recent lawsuit against Stability AI, Midjourney, and DeviantArt accuses these companies of using millions of images without permission to train their models. Artists are therefore demanding financial compensation and greater transparency in the use of their works.

Loss of the Human Component

Art is more than the mere creation of images; it is about expressing human emotions and experiences. Many artists criticize AI-generated artworks as soulless and homogeneous. As one artist put it, “AI artworks look like a homogeneous mass of all humanity’s art, but without any humanity.”

Ethics and Cultural Distortion

Ethical concerns also play a significant role. AI models, primarily trained on Western artworks, could reinforce cultural biases and reduce the visibility of art from other cultures. This threatens the cultural diversity and sustainability of the art scene.

Artists want to retain control over the use of their works. The unauthorized use of their artworks by AI models is seen as a violation of this autonomy. They demand a right to transparency and the ability to opt-out of using their works for AI training purposes.

Human Resonance and Digital Media

An interesting aspect of the discussion around AI in art is audience perception. Cornelia Es Said, a visual artist from Berlin, observes that people on social media often respond more strongly to AI-generated images than to purely human-made artworks. She suspects this is partly due to the inevitable media break between the analog capture of oil paintings and their digital representation. Digital artworks are created for the digital space from the outset and avoid this break. Additionally, AI generators might tap into the collective consciousness through their training data, reflecting human needs more strongly.

This observation  is supported by the Goldmedia study, which shows that a significant majority of art recipients (64%) are interested in art created with the help of AI. This suggests that AI artworks can generate a strong emotional resonance with the audience, possibly even stronger than traditional artworks when digitally represented.

The introduction of AI into the art world brings numerous contradictions and dilemmas. On the one hand, the technology offers new creative possibilities and can expand access to the art market. On the other hand, it threatens the livelihood of many artists and raises fundamental ethical and legal questions.
